What is Score Simulator?

Score Simulator is a tool that allows you to simulate different credit actions on your existing CIBIL Report, and generates a simulated CIBIL Score. This helps you understand how various credit actions can impact your existing CIBIL Score thus empowering you to take informed decisions.

How does the Score Simulator work?

The Score Simulator allows you to choose from various simulations - such as

  • Opening / closing or new loan accounts,
  • Paying off outstanding amounts on credit cards
  • Adding late payments to your active loan accounts

On choosing a particular simulation, you will be asked for some additional details needed for the simulation for e.g. if you choose to add a new credit card, you will be asked for a 'Credit Limit'. On entering the additional details you will be able to check your simulated CIBIL Score.

Where can I find the Score Simulator?

You need to have an active paid subscription (1-Month, 6-Months or 1-Year Unlimited Access) in order to access the Score Simulator. Once you have an active paid subscription, you will be able to access the Score Simulator tool under the Score Simulator tab in your CIBIL account.

Why is my Simulated Score the same as my Current Score ?

Your CIBIL Score is a 3-digit numeric summary of your credit report and is dependent on multiple factors, which might be unique to every individual.

How does Alerts help me?

79% of loans are approved for individuals with a CIBIL Score greater than 750. What is a CIBIL Score and Report?

How do I read my CIR?

A CIR has detailed information on the credit you have availed, such as home loan, automobile loan, credit card, personal loan, overdraft facilities. Below are the key sections of the CIR

CIBIL Score

Your CIBIL score, calculated based on your credit behavior as reflected in the 'Accounts' and 'Enquiries' section of your CIR, ranges between 300-900. A score above 700 is generally considered good.

I have an add-on credit card. Why are the details reflecting on my account when I am not liable to pay?

It is important to note that even if primary card holder is responsible for payments for charges incurred on both the primary and add-on credit card. Any default made in payments shall reflect in CIR of both the primary and add-on card holder.

Why are the loans for which I am a guarantor showing up on my report?

Banks and Financial institutions ask for a guarantor for certain loans as a means of security for the loan amount they provide. A guarantor on any form of loan is equally responsible to ensure the repayment of the loan. Hence, the guarantor provides a guarantee to the lender that he will honor the obligation in case the principal applicant is unable to do so. Any default on the payment of the loan by the principal applicant, will affect your CIBIL Score as well.

I have closed all my accounts on time with the bank and have NOC. Why is it still showing as outstanding on my report?

The reason it may be still reflecting in your CIBIL Report is because the updated information has not been provided to CIBIL by the concerned Credit Institution (CI). You can raise a dispute with CIBIL and we will update you with the response from the CI. As per the Credit Information Companies (Regulation) Act of 2005, we cannot modify any information in the database without confirmation from the concerned Credit Institution.

I have an add-on credit card. Why are the details reflecting on my account when I am not liable to pay?

Even though a primary card holder is responsible for payments of charges incurred on both the primary and add-on credit cards, any missed payment reflects in the primary and add-on card holder's CIRs. This will impact both card-holders' CIBIL Scores.

Why are the loans for which I am a guarantor showing up on my report?

Lenders ask for a guarantor for certain loans as a means of security for the loan amount they provide. A guarantor on any form of loan is equally responsible to ensure the repayment of the loan. Hence, the guarantor provides a guarantee to the lender that he will honor the obligation in case the principal applicant is unable to do so.

Any default on the payment of the loan by the principal applicant, will affect your CIBIL Score as well.

I have closed all my accounts on time with the bank and have NOC. Why is it still showing as outstanding on my report?

If the updated information has not been provided to CIBIL by the concerned Credit Institution (CI), this will continue to show as an outstanding. You can raise a dispute with CIBIL and we will update you with the response from the CI. As per the Credit Information Companies (Regulation) Act of 2005, we cannot modify any information in the database without confirmation from the concerned Credit Institution.

My loan has been rejected because of the defaults reported against my name in CIBIL records. How do I remove my name from the CIBIL's defaulters list?

CIBIL doesn't maintain a defaulters list. We maintain the credit history of individuals as reported by banks and other lending institutions. The decision to grant a loan is solely dependent on the credit policy of the lender. In order to check your credit history in detail and to identify any possible discrepancies / errors that might be reflecting against your name, monitor your CIBIL Score and Report regularly.

What kind of inaccuracies can reflect on my CIBIL report?

Ownership

If either some of the personal details or one or more accounts / enquiries on your CIBIL Report do not belong to you.

Incorrect personal details

Credit Institutions submit details of your credit account along with your personal / contact / employment information such as name, address, date of birth, PAN, telephone number, income etc. CIBIL then creates your complete credit profile basis these details. Hence, it is important to update your Credit Institution every time there is a change in the information as incorrect details may lead to a wrong CIBIL Report being generated.

Inaccurate account details

Credit Institutions generally submit data to CIBIL within a span of 30 - 45 days and if you happen to access your CIBIL Report within 45 days of your last payment of dues, it may not be updated. This leads to reflection of inaccurate current balance or amount overdue in your CIBIL Report. However, if the 'Date Reported' (date on which data is submitted by that lender) associated with that account is older than 2 months, and the payment made is still not reflecting then you can raise a dispute.

Can CIBIL make correction to the data or update / delete any information in the CIBIL Report?

Please Note -You can dispute multiple fields and information on your report in a single dispute by navigating to each section on the Online Dispute Form (i.e. Personal, Contact, Employment, Account Details and Enquiry).

Once the dispute is submitted, CIBIL will also mark the relevant field/ account/ section on your credit report as "Under Dispute".

It may take approximately 30 days to resolve a dispute, subject to the time taken by the Credit Institution to respond.

My report is incomplete. Can CIBIL add information to my CIBIL Report?

CIBIL cannot add any information directly to your CIBIL Report. The information available on your CIBIL Report is as reported to us by Credit Institutions (CIs). I am unable to submit a dispute without entering the branch details? What can I do?

Certain banks cannot resolve your dispute unless they have the details of the branch where you have obtained the loan from. Hence, we have automated the process of collecting the branch details from you at the time of initiating the dispute. Providing the branch details will enable the bank route your dispute to the correct branch which will help expediting the dispute process. In case you do not have the branch details, you will need to contact the respective credit institution.

Why can't I raise more than one dispute type on a particular account / enquiry?

You can either dispute ownership or the fields of an account / enquiry.

If you have disputed the ownership (Account does not belong to you) then disputing other fields is not relevant.

If you are disputing the field for a particular account / enquiry which belongs to you, disputing ownership is not applicable.

What does CIBIL do once I have raised a dispute?

Once you have submitted the dispute, CIBIL will verify the dispute internally and route it to the concerned credit institution. Once the CI responds to the dispute request, CIBIL will update the changes instantly (if applicable), and communicate the status to you via email.

How do I know the status of my dispute?

You will receive an automated email notification regarding the status of your dispute every 7 days.

I had raised a dispute for correcting information on my CIBIL Report but I have received a notification that I need to contact my credit institution, Why?

CIBIL cannot make a change to your CIBIL Report until authorized by the Credit Institution. This could either mean that CIBIL cannot update the information basis data provided by the credit institution or the credit institution has rejected your dispute. You will need to contact the concerned Credit Institution (CI) directly for further information or you can initiate a dispute request again and we will re-verify it with the relevant CI.

Why doesn't CIBIL verify information with consumer before updating the report?

The information available on your CIBIL REPORT is as reported to CIBIL by Credit Institutions (CIs). The onus lies with the CIs to report the facts accurately to CIBIL. CIBIL's responsibility lies in accurately updating and accumulating this information across CI's. In case you find any data inaccuracy in your CIBIL REPORT you can initiate a dispute with us and we will get the inaccuracies verified with the concerned CI. Any changes have to be authorized by the concerned CI for it to be updated in CIBIL records to reflect in your CIBIL REPORT.

What if I'm not satisfied with the results of dispute?

You can choose to contact the concerned Credit Institution (CI) directly. Alternatively, you can initiate a dispute request again and we will re-verify it with the relevant CI. Please note, we cannot make any changes to your CIBIL Report without the confirmation of the respective CI.

I see the message that certain information on the report is under dispute? What does this mean?

An alert (as highlighted in the below image) indicates that the information in certain sections of your CIBIL Report is disputed. The alert notification will be removed only once the dispute is resolved.

What action will CIBIL take if the CI does not resolve the dispute within 30 days?

CIBIL cannot modify any information in the database without confirmation from the relevant Credit Institution. We have an automated process where a daily reminder will be sent to the bank / CI until the dispute is resolved.

How much time does CIBIL take to update information once the bank has responded to the dispute?

Once we get the corrected data from the Credit Institutions (CI), we update our records instantly.

My account has not been updated for more than 2 months. What should I do?

There could be 2 reasons why your account has not been updated:

  • Credit Institution has not submitted your recent data to CIBIL
  • There is an ongoing dispute on your account

You can contact your credit institution directly and request them to take appropriate action.

I have approached the CI to update my account details, however I have not received any update?

If you have approached the credit institution directly to update your account in CIBIL records, the onus lies with the CI to send you an update. You can contact your credit institution to know the updated status of your account. Alternatively, you can click here to know the updated status of your account.

Phishing

Phishing is an attempt to obtain any type of sensitive or personal information such as login credentials, banking and card details or even personal identifiers (like your PAN and AADHAR number) through deceitful means, such as impersonating another in any kind of electronic communication. This is used by cyber criminals to trick users into revealing sensitive confidential data simply by luring them through fake emails and websites.

Did you know that spear-phishing is a targeted cyber-attack to trick a specific group of people/organizations by sending emails to gain access to what they need?

What to watch out for

  • Congratulatory or warning emails from unknown senders
  • An email with a call-to-action to "click here for a prize/cashback/points"
  • A mismatch in the sender's email address vis-à-vis the official email address
  • Emails addressing you with a generic title such as "valued customer" instead of your name
  • Emails appearing to be from executive leadership you work with, requesting information about you or colleagues that they usually do not ask for
  • Unexpected emails asking for your personal information or your immediate action

How to avoid falling prey to it

  • Do not click on links or open attachments from unknown senders
  • Do not respond to or forward suspicious emails that may be a scam
  • Always make sure that the sender's email address matches the official address
  • If in doubt, contact the person or organization (as claimed in the email) by using contact information provided only on their official website
  • Always hover your mouse over the link to see if it will direct you to a legitimate website
  • Do not enter any personal, login, or financial information when prompted by an unsolicited email

Vishing

Vishing (voice or VoIP phishing) is an electronic fraud tactic that can be conducted by voice email, VoIP (voice over IP), landline or cellular telephone. Vishing is the telephone equivalent of phishing, where fraudsters trick the user into divulging sensitive data by pretending to be someone else over a phone call. This private information can be used for identity theft.

What to watch out for

  • A caller exhibiting over-friendly behavior (calling you by your first name or making small talk to get to know you)
  • A caller who claims to work for a company or organization you trust (such as a bank, a software vendor, police department, or government agency)
  • Threatening calls reiterating a fine or charge that must be paid immediately
  • Calls claiming to distribute exaggerated/fake prizes, products, or services such as credit and loans, extended car warranties, charitable causes, or computer support
  • A phone call requesting for login credentials or personal sensitive information, or suggesting you make a payment using odd methods, like gift cards
  • Pre-recorded phone call messages or robocalls.

How to avoid falling prey to it

  • Never share sensitive information over a phone call
  • Be suspicious of all unknown callers
  • Always cross question the caller if you have any doubts

Smishing

Smishing stands for "SMS phishing," a security attack in which the user is tricked into downloading a Trojan horse, virus or other malware onto his cellular phone or other mobile device. This can also include fraudulent messages sent over on SMS to the trick user into divulging sensitive information.

What to watch out for

  • Suspicious messages from unknown senders
  • Impersonations of a business such as your bank or mobile service provider who try to convince you to respond to the message with information or ask you to click a link to log into your account or provide requested information, indicating a problem with your account and immediate action
  • Text or SMS claiming you have won a prize or enticing you to click a link or send information to be entered to win something

How to avoid falling prey to it

  • Do not call back on a phone number provided in any suspicious SMS
  • Do not trust a sender just because their sender name is an abbreviated form of an assumed word, e.g. ICBNK
  • Avoid clicking on any URL in the SMS
  • Avoid downloading any app from a link mentioned in a suspicious SMS

    • Ensure your apps are updated regularly and watch out for new updates or permissions that the app may require.
    • If you are using a banking app or any other app for financial transactions, follow basic tips such as protecting your phone with a password, not changing factory security settings and/or logging out from the app when finished.

    • When shopping online, or visiting websites for online banking or other sensitive transactions, ensure the site's address starts with "https", instead of just "http", and has a padlock icon in the URL field.
    • Equip your computer with an updated anti-virus software.
    • Ensure your computer and mobile device have the latest software versions installed.
    • Change your password every 2 months.
    • Do not share your sensitive data as that may lead to identity theft.
    • Do not re-use your office computer password for personal emails and services.

TERMS AND CONDITIONS FOR PROVISION OF SERVICES

This document lays out the terms and conditions and rules, as may be amended and supplemented, from time to time, (Terms) which shall be applicable to the provision of: (i) Credit Information Reports (Individual CIRs) and Company Credit Information Report (Company CIRs) (collectively referred to as, Reports) either /or for (a) Free Annual Credit Report and Score (as mandated by the Reserve Bank of India) (b) Subscribed Product ( Unlimited Access within the subscription period) (c) Featured Offers (d) Personalized Loan Offers to either an individual, a partnership firm, a company (as defined in section 2 (20) of the Companies Act, 2013 ), a body corporate (as defined under Section 2(11) of the Companies Act, 2013), a co-operative society, a trust, an association of persons whether incorporated or not, and any other entity, and shall include their heirs, representatives, successors and assigns, as permitted and applicable, (Persons) who can apply for the CIRs and/or the Commercial CIRs, under applicable law; (ii) Featured Offers and (iii) any other products and services rendered by TransUnion CIBIL to the Persons (collectively referred to as, Products and Services) by TransUnion TransUnion CIBIL Limited ("TransUnion CIBIL") having its registered office at One World Center, 19th Floor, Tower 2A, Senapati Bapat Marg, Elphinstone Road, Mumbai - 400 013 (Transaction).

The words, "I", "We", "us", "me", "my", "myself", "customer" and "consumer" refer to the Person(s) who request for their respective Reports or receive the Products and Services or pursue the Transaction (as defined hereinabove) or part thereof (Consumer) and shall include both singular and plural. Reference to the masculine gender shall include the feminine and neutral gender or any other legal entity.

I acknowledge and expressly agree with the following terms and conditions:

GENERAL

I/We have read, understood and agree to abide by these Terms including any changes thereto made by TransUnion CIBIL in its sole discretion, from time to time, relating to my Transaction with TransUnion CIBIL, which changes shall be made available on TransUnion CIBIL's website/s (www.cibil.com and www.transunioncibil.com). I/We agree that the Terms form a valid contract between myself/ourselves and TransUnion CIBIL, and that TransUnion CIBIL may, at its sole discretion, amend the Products and Services relating to the Transaction and/or the Terms, either wholly or partially, at any time in the manner stated above and without the requirement of any prior notice or consent.

I/We agree that these Terms constitute the entire agreement between myself/ourselves and TransUnion CIBIL with respect to the Transaction and these Terms supersede all prior or contemporaneous communications and proposals, if any, whether electronic, oral, or written, between me/us and TransUnion CIBIL with respect to the Transaction. A printed version of these Terms and of any notice given in electronic form shall be valid and admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as any other documents and records originally generated and maintained in printed form.

I/We agree and understand that that any and all information contained in the Reports and the Products and Services has been collated by TransUnion CIBIL based on the information provided by its various member banks and credit institutions (Members). Consequently, TransUnion CIBIL shall not be responsible for the accuracy, completeness, and veracity of any and all such information as provided. I/We also understand that the information is current and up to date to such extent as provided by the Members and is subject to changes and amendments made thereafter and that any information contained herein does not reflect the views of TransUnion CIBIL or its directors or employees. Also, TransUnion CIBIL shall incur no liability and shall not be required to indemnify me/us for any loss, damages, claims or expenses incurred by me/us for any incorrect reports provided due to incorrect information and/or documents provided by me/us or if for any technical reason, any incorrect report is provided otherwise.

I/We agree that the provision of the Reports and the Products and Services shall be limited to the territory of India.

The information contained in the Reports shall be updated upto such dates which the relevant Members with whom I/we have a relationship with, has provided information to TransUnion CIBIL based upon which updated information TransUnion CIBIL has been able to update the Reports and TransUnion CIBIL shall not be responsible in the event my information is not updated by the Members.

I/We understand and agree that TransUnion CIBIL shall not be required to seek prior permission from me/us for updating information that may be reported to TransUnion CIBIL by the Members or otherwise come to the information of TransUnion CIBIL and TransUnion CIBIL shall not be responsible to verify the correctness of the information received hereby. TransUnion CIBIL shall reproduce the information submitted to it by its Members on "as is" basis.

TransUnion CIBIL shall have the right to terminate provision of the Report/s and/or the Products and Services or any part thereof, at its sole discretion at any time. Further, notwithstanding the Terms contained herein, TransUnion CIBIL reserves the right to reject my Request Form (defined below) made due to any reason whatsoever and shall not be required to specify such reason for rejecting the same.

TransUnion CIBIL reserves the right to initiate legal proceedings including criminal proceedings against the perpetrators of fraud, money laundering or any other form of wrong doing in relation to the Products and Services. I/We have read in full and have completely understood the steps to access Report/s and/or the Products and Services offered on TransUnion CIBIL's website/s (www.cibil.com and www.transunioncibil.com).

An 'insufficiency' would have taken place, including but not limited to, any of the following reasons:

  • Address proof not provided, invalid (not acceptable as defined by TransUnion CIBIL) or is expired (not currently relevant);
  • ID proof not provided or is invalid (not acceptable as defined by TransUnion CIBIL) or is expired (not currently relevant);
  • Address or ID proof does not match with that provided on the Request Form;
  • Personal Information not matching on the Reports and/or Request Form and/or the identification documents provided;
  • Request for the Individual CIR of a minor;

REQUEST FORMS FOR PRODUCTS AND SERVICES AND PROOF OF IDENTITY AND ADDRESS

1. I/We understand that all applications for the Report/s or the Products and Services shall be provided by TransUnion CIBIL only on the submission by me/us of the duly completed request forms, the Credit Information Report, as may be applicable, for the Reports and/or the relevant Products and Services, as may be applicable, or through the user form available online (Request Form) which may be obtained or accessed at TransUnion CIBIL's website/s (www.cibil.com and www.transunioncibil.com).

2. I/We agree to comply with the KYC requirements as required by TransUnion CIBIL and specified by TransUnion CIBIL from time to time.

3. Any application made by me/us other than in the prescribed Request Form or which are incomplete in any manner shall not be considered a valid application and will be rejected by TransUnion CIBIL without providing any reason whatsoever.

4. All details provided by me/us in the Request Form should match the details provided by me/us to any of the Member who I have any type of relationship with or in the event I/we do not have any relationship with any Member, the details that are similar to that as provided in the Address Proof (as defined hereinafter) as mentioned herein.

5. Proof of my/our identity (Identity Proof) and proof of my/our address (Address Proof) shall be required to be submitted by me/us along with the Request Form, and in the event I/we fill the Request Form online on TransUnion CIBIL's website, such documents shall be required to be posted by me/us to TransUnion CIBIL at the following address (Processing Address): Consumer Relations, TransUnion CIBIL Limited, One World Center, 19th Floor, Tower 2A, Senapati Bapat Marg, Elphinstone Road, Mumbai - 400 013.

6. TransUnion CIBIL shall not be responsible if any of the documents relating to my/our Identity Proof or Address Proof are lost in transit prior to receipt of such documents by TransUnion CIBIL at the abovementioned processing address.

7. I/We agree that all documents provided along with the Request Form shall be valid and should not have expired, as applicable. Further, I/we agree that copies of the documents provided shall not be returned by TransUnion CIBIL irrespective of the fact whether or not the Credit Information Report or any other Products and Services is made available and/or provided to me/us.

8. All documents relating to the Request Form, Identity Proof and Address Proof must reach TransUnion CIBIL at its Processing Address within 7 (seven) business days of the date of filing of the Request Form. Payment of appropriate charges and any documents, payments, verification, clarifications and other information should be provided by me/us within a period of 90 (ninety) days from the date of the filing of the Request Form, upon the expiry of which the application shall be considered as incomplete and a fresh Request Form shall have to be provided along with all other necessary documents including payment of requisite fees in relation thereto.

9. I/We understand that if due to the provision of wrong or incomplete information provided by me/us in the Request Form, or for online ID Authentication Process, as may be applicable, an incorrect Report or such Service as the case may be is received by me/us and in that case, TransUnion CIBIL shall in no manner be responsible for the same and any subsequent request for a fresh Report or such Service as the case may be shall be treated as a fresh request and application and hence shall be charged accordingly.

Also, due to the provision of wrong or incomplete information provided by me/us in the Request Form, or for online ID Authentication Process, as may be applicable, the Report so generated may belong to a person other than me/us, and may be sent to such person at my/our cost. In such cases, I understand that TransUnion CIBIL shall not be liable to refund any payments made by me/us in this regard and that I/we shall have to furnish a fresh Request Form and submit fresh payment for my/our Credit Information Report.

TERMS AND CONDITIONS OF PAYMENT

1. The charges for the Subscribed Products and Services shall be as stipulated by TransUnion CIBIL from time to time and I/we agree to pay the same. The charges for any Subscribed Products and Services may be amended by TransUnion CIBIL from time to time subject to applicable laws.

2. I/We acknowledge and agree that the charges as specified are the cost of a Report or other Products and Services, as may be applicable and other charges including any delivery charges, payment gateway charges and taxes and other duties which shall be payable by me/us, as applicable and prescribed by TransUnion CIBIL relating to costs that TransUnion CIBIL may incur for the purposes of facilitating me/us in the payment mechanism and in getting my/our Report or other Products and Services delivered at my/our validated address.

3. I/We understand that the payment gateway and net-banking channels may not belong to TransUnion CIBIL and agree to abide by the rules and regulations and terms prescribed by such third party in the process of facilitating my/our payment through the said payment gateway and net-banking channels.

4. A request once made by me/us shall not be cancelled and no charges relating to such order shall be refunded. However, I/we understand that there may be instances when no Report, as may be applicable, is generated because the Credit Information does not exist in TransUnion CIBIL's database or the details provided by me/us were not adequate to access the relevant Credit Information. In such cases, a "no-hit" report will be generated by TransUnion CIBIL and provided to me/us. I/We understand that a 'no-hit' Credit Information Report may not provide any information.

5. I/We understand that unless complete and full payment along with submission of the required documents is made by me/us, TransUnion CIBIL shall not be obliged to process or issue any Credit Information Report to me/us.

PAYMENT MODES

Payment through Credit Cards/Debit Cards:


I/We understand that any payment for the Products and Services through my/our VISA or MASTERCARD or other service provider (as provided by the Payment Gateway Merchant) Credit Card or Debit Card as the case may be, may be made.

Payment through Net Banking:


I/We understand that a payment of the stipulated charges for Reports and/or Products and Services may be made through my/our Net Banking channel.

TERMS OF PAYMENT

Charges for Credit Information Report: I/We agree to pay such amount as stipulated by TransUnion CIBIL for the issue of my Credit Information Report. The charges are inclusive of delivery charges, payment gateway charges (if any) and all applicable taxes.

If the payment is made through Credit Card or Debit Card:

1. I/We represent that the Credit Card or Debit Card used by me/us to make payment herein, is my/us own Credit Card or Debit Card or I/we have full authority and permission to use the same to make payment herein.

2. Processing of the Request Form shall take place only after TransUnion CIBIL realises the payment through from the Credit Card/Debit Card payment gateway merchant for the full amount. In the event there is any error in the payment of the full amount through this mode, the relevant Request Form shall not be processed.

In the event payment is made more than once for the same transaction, I/we understand I/we am /are required to email TransUnion CIBIL at [email protected] or call TransUnion CIBIL at +9122-61404300 or such other number as TransUnion CIBIL may intimate on its Website/s (www.cibil.com and www.transunioncibil.com) from time to time and inform TransUnion CIBIL of the same. Upon request by TransUnion CIBIL, I/we shall provide the relevant reference number from the issuing bank or financial institution providing net banking services or issuing the Credit Card/Debit Card, as the case may be, in order to reverse such duplicate payment. I/We understand such reversals shall be made to the same account from which payment was made or the same Credit Card/Debit Card from which payment was made, as the case may be, and that TransUnion CIBIL shall make its best endeavours to credit the refund after the expiry of at least 4 (four) working days.

TransUnion CIBIL shall not be liable in any manner whatsoever for any fraud that may be committed on my/our net banking account or my Credit Card/Debit Card, as the case may be, whether due to loss or theft or otherwise.

The technology for enabling the payment by way of net banking services or Credit Card/Debit Card could be affected by virus or other malicious, destructive or corrupting code, programme or macro. This could result in delays in the processing of instructions or failure in the processing of instructions. TransUnion CIBIL shall not be liable, whether direct or indirect, whether arising out of loss or profit or otherwise arising out of any failure or inability by the relevant bank or financial institution to honour any customer instruction for whatsoever reason.

I/We understand that the Net Banking channel is available only if I/we have an online banking account with my/our bank or financial institution from where the said amount will be directly debited from my/our account with my/our instructions online and such facility is available only if I/ we hold an account with the banks as maybe provided by payment getaway merchant and/or TransUnion CIBIL, from time to time.

If the payment is made through net banking facilities:


1. I/We shall use only my/our own net-banking account details to transact on this Website or have full authority and permission to use the net-banking account to make payment as required herein.

2. Processing of the Request Form shall take place only after TransUnion CIBIL realises the payment through from the net-banking payment gateway merchant for the full amount. In the event there is any error in the payment of the full amount through this mode, the relevant Request Form shall not be processed.

Under this Section the consumer may be offered loans from participating lenders if they meet the eligibility criteria decided by such participating lenders. The final decision on sanction rests with the participating lenders and TransUnion CIBIL is not liable and/ or responsible for the same. Under Personalized Loan Offers TransUnion CIBIL provides an online platform which enables a consumer to view and choose from multiple offers across products and from participating lenders. The offers are customized basis the TransUnion CIBIL Score, Income and Other Credit parameters. Loan approval is subject to documentation and verification as per lenders credit policy.

1. I/We acknowledge and consent to:

  • receiving the products and services offered by various Members of TransUnion CIBIL (Member Services) on the TransUnion CIBIL Website (www.cibil.com ) or a link to Member website provided on TransUnion CIBIL Website
  • submitting my/our data, including contact details, or any other personal details available with you or obtained from us by you and/or credit information (each as construed under the applicable law and common parlance) (my information) to the Member as selected by us on the Website (Selected CI) to enable them to send offers, solicitations or other product brochures to me/us and to contact me/us
  • expressly waive any and all rights available to me/us under the Telecom Commercial Communications Customer Preference Regulations, 2010 and any other applicable law in relation to the offers or solicitations made by Selected CI

2. I/We shall not hold TransUnion CIBIL and/or any of its technical service providers responsible or liable for any loss, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to: (a) delivery of my information to the Selected CI; (b) any use, modification or disclosure by the Selected CI of my information, in whole or in part, whether authorized or not; and (c) any breach of confidentiality or privacy in relation to delivery of the my information by the Selected CI.

3. I/We further acknowledge and accept:

  • That the implementation of the end use policy of the Selected CI, if any, is solely the responsibility of the Selected CI, and I/we shall not hold TransUnion CIBIL liable for any use made by the Selected CI which is contrary to the end use policy or otherwise.
  • That any credit facility provided or to be provided to me/us pursuant to our activities on this Website by any Member including the Selected CI shall be the sole discretion of such entity as per the credit criteria and other criteria set/selected by such entity. I/We further acknowledge and accept that I/we may or may not be able to receive any credit facility offers from any Member, including the Selected CI since the same is dependent on my/our credit profile, as also the credit criteria and filter criteria set/ selected by a Member, including the Selected CI.

Your CIBIL Score and Report may change whenever a Member accesses your report or submits new or updated information on the credit facilities you have availed. The new Alerts feature monitors your CIBIL Score and Report and sends you real-time SMS and email notifications that your CIBIL Score and Report has undergone a change. This feature is made available by TransUnion CIBIL free of charge for all its consumers who have opted for a 6-month and 1-year subscription plans.

In terms of the same, I/We acknowledge and consent:

  1. to receiving the Alerts from TransUnion CIBIL through itself or its authorized service providers/agents
  2. having assented to receiving SMS (es)/Email (s) on the mobile number and email id provided by me at the time of making an application / subscribing any product or as and when updated by me/us and such mobile number and email id shall be considered to be my registered mobile no and / or email id. I /We further acknowledge and agree for TransUnion CIBIL to send to me/us an alert in case of any update or any change in the credit information and/or TransUnion CIBIL Score so reflecting at the relevant time in my/our Report. I also agree to TransUnion CIBIL sending me/us such alerts even after my subscription has expired so as to enable me to decide if I/We wish to renew the subscription.
  3. that this service / product feature has been provided to me/ us on account of the subsctiption product that I/ We have not to raise any dispute and/or legal proceedings against TransUnion CIBIL for sending such SMS(es) or Emails and/or hold TransUnion CIBIL liable / responsible for any losses/ claims / damages in this regard
  4. not to hold TransUnion CIBIL responsible / liable for any decision that I/We make with regard to renewing or not renewing the subscription

This feature is made available by TransUnion CIBIL free of charge for all its consumers who have opted for all active paid subscription plans (1-month, 6-month and 1-year subscription).

I/We acknowledge and agree that the Score Simulator cannot be used as a prediction tool to guarantee any outcome. This simulator is meant for informational and educational purposes only and it to be used is merely an indicator of a hypothetical score based on the scenarios chosen by me/us. It is only an estimate and does not provide a guaranteed result. I/We shall not hold TransUnion CIBIL liable or responsible for any errors or omissions, including but not limited to technical inaccuracies. Further, I/We shall not hold TransUnion CIBIL liable for the consequences of any decisions or actions taken in reliance upon and / or based on the result of the information / tools provided by this Simulator. Further, I / We shall not hold TransUnion CIBIL Liable and / or responsible for any losses/ claims / damages caused to me/us in any manner whatsoever. TransUnion CIBIL disclaims all such liabilities.

RAISING A GREIVANCE OVER ANY INFORMATION

A grievance request can be raised by me/us, by visiting TransUnion CIBIL website/s (www.cibil.com and www.transunioncibil.com). TransUnion CIBIL will initiate the dispute with the relevant credit institution and notify appropriately.

I/we agree and understand that TransUnion CIBIL may suspend any or all of the services and/or Transaction mentioned herein, including raising of a grievance request as set out above, and upon the happening of the same, TransUnion CIBIL shall not be under any obligation to process the grievance request raised by me from such date of suspension.

REFUNDS AND CHARGE BACK

1. In the event a request made by me/us in relation to a Service is not a valid request, or if it is rejected by TransUnion CIBIL for any reasons whatsoever or TransUnion CIBIL is unable to provide the same, I/we agree to pay to TransUnion CIBIL, processing charges and TransUnion CIBIL shall refund to me/us such amounts as may be decided by TransUnion CIBIL in its sole discretion from time to time.

2. Only for the following reasons and any other reasons decided by TRANSUNION CIBIL at its sole discretion, TransUnion CIBIL shall refund the payments made by me/us after deducting the relevant processing charges as may be required by TransUnion CIBIL, in its sole discretion, from time to time:

In case of Transactions through Net Banking/using Debit or Credit Cards and in the event of a fraudulent transaction carried out on my/our bank account/card without my/our authorisation verified by the police;

In the event of any technical snags between my/our computer and/or TransUnion CIBIL and/or the issuing bank wherein my/our transaction could not be completed, whereby I/we was/were charged twice for a single transaction (duplicate processing).

DELIVERY OF REPORT/S AND OTHER PRODUCTS AND SERVICES

1. I/We understand and agree that delivery of the Report/s and/or Products and Services will be provided through a login based dashboard. The access will be provided only basis successful authentication as per TransUnion CIBIL’s standard authentication process.

2. On any change in my personal information and/or address, I/we shall update my address in the records of the relevant Member/s with whom I/we have my respective relationship account/s, else, TransUnion CIBIL would not be able to deliver the Report at my/our desired address.

3. I/We understand and agree that in case I/we provide email address for delivery of the Report/s and/or Products and Services by opting for delivery through email, TransUnion CIBIL shall not be responsible for the correctness of the email ID and delivery of the Report/s and/or Products and Services made by TransUnion CIBIL to such email address (with encryption) shall be complete dispatch of the Report/s and/or Products and Services.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

1. I/We acknowledge, understand and agree that by providing the Report/s and the Products and Services (whether through this Website/s (www.cibil.com and www.transunioncibil.com) or otherwise), TransUnion CIBIL is acting as a facilitator. TransUnion CIBIL, thus, does not warrant that the functions contained in the above mentioned Website/s will be uninterrupted or error free, that defects will be corrected, or that this Website/s or the servers that make it available are free of viruses or other harmful components, but shall take commercially reasonable efforts to correct the delays in operation of the Website/s.

2. In no event shall TransUnion CIBIL be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages..

3. I/We acknowledge, understand and agree that, without limiting the above clause 2, TransUnion CIBIL shall not be responsible and disclaims all responsibilities for any claim, liability, or any damage resulting from, arising out of, or in any way related to: (a) the use or the inability to use the Report/s and/or the Products and Services or this Website; (b) the cost of procurement of substitute services; (c) unauthorized access to or alteration of transmissions or data; (d) any other matter relating to the provision of services for underlying Transaction; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website/s, the Report/s and/or Products and Services, or otherwise, (e) any errors in or omissions from this Website/s, including but not limited to technical inaccuracies and typographical errors, (f) any third party websites or content therein directly or indirectly accessed through links in this Website/s, including but not limited to any errors in or omissions therefrom, (g) the unavailability of this Website/s or any portion thereof, or (h) my use of any equipment or software in connection with this Website/s.

4. I/We agree that I/we shall not hold TransUnion CIBIL liable or responsible for non-availability of its Website either due to internet connectivity speeds or errors on my/our computer or during periodic maintenance operations or any unplanned suspension of access to the Website that may occur due to technical reasons or for any reason beyond TransUnion CIBIL's control. I/we understand and agree that any material and/or data downloaded or otherwise obtained through this Website/s is done entirely at my/our own discretion and risk and I/ we will be solely responsible for any damage to my/our computer systems or loss of data that results from the download of such material and/or data.

5. I/We understand and accept that no information with regards to the Report/s, the Request Form, the Reports or any of the Products and Services shall be provided by me/us vide telephone or in person or vide e-mail excluding vide the document relating to Identity Proof or Address Proof. If any information is provided by me/us vide telephone or in person or vide e-mail excluding vide the document relating to Identity Proof or Address Proof, TransUnion CIBIL shall have no responsibility for any damage or loss to me/us due to such provision of information by me/us.

6. This Website/s is on an "as-is", "as available" basis and TransUnion CIBIL expressly disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Apart from above, the respective Report/s and/or Products and Services shall have their disclaimers. I agree, acknowledge and accept the same.

MISCELLANEOUS

1.Severability

In the event that any provision of these Terms is declared by any juridical or other competent authority to be void, voidable, illegal or otherwise unenforceable or indications of the same are received by either me/us or TransUnion CIBIL from any relevant competent authority, TransUnion CIBIL shall have the right to amend that provision in such reasonable manner as it thinks fit without illegality or it may be severed from this Agreement in such manner as TransUnion CIBIL thinks fit and the remaining provisions of these Terms shall remain in full force and effect unless TransUnion CIBIL decides in its sole discretion to stop the provision of the Report/s and/or Products and Services either wholly or in part.

2.Variation

In furtherance of these Terms and subject to applicable laws, I/we understand that TransUnion CIBIL reserves the right to issue further directions which shall be applicable to me/us from, time to time. Other than as otherwise provided by these Terms, all alterations to these Terms shall be made by TransUnion CIBIL with an intimation on this Website and shall become applicable upon such intimation, and without the requirement of any prior notice or intimation to any Consumer of such variation. I/We agree to accept any such variation made by TransUnion CIBIL in this regard regardless of the mode through which I/we have approached TransUnion CIBIL.

3. Non- Assignment

I/We shall not assign or transfer any of my rights and/or obligations in relation to the transaction contemplated herein under or pursuant to these Terms to any other person.

4. Indemnification

I/We agree to defend, indemnify, and hold harmless TransUnion CIBIL, its officers, directors, employees, agents, licensees, affiliates, advisors, successors and assigns from and against any and all loss, damage, liability, claim, demand, suit, cost and expense (including court costs and reasonable attorney fees) suffered and/or incurred (as the case maybe) by TransUnion CIBIL and/or resulting from: (i) breach by me/us of any these Terms; (ii) claims made against TransUnion CIBIL by third parties including any bank/credit institution arising pursuant to the provision of services with respect to the Transaction and/or any matters incidental thereto.

5. Miscellaneous

I/We hereby confer TransUnion CIBIL with the right to use any data and information provided by me/us vide the Request Forms in any manner including for any purpose stipulated by TransUnion CIBIL, provided that the same shall be valid under applicable law.

I/We hereby consent to TransUnion CIBIL to use my device information of the device (that I may use to login/access TransUnion CIBIL webpages, website, applications, platform, etc.) to identify suspicious and/or high-risk devices used to access any website and mobile applications and detect fraudulent activities. I/We understand that by providing my/our mobile number and email address. I/we have assented to receiving SMS (es)/Email (s) and I/we may be sent SMS (es)/Email (s) to update status of my/our order for Report/s / Products and Services on TransUnion CIBIL's Website/s (www.cibil.com and www.transunioncibil.com). I/We further understand that by providing my/our said mobile number and email address (es), I/we have also assented to receiving calls and emails from TransUnion CIBIL, their agents etc. regarding any other TransUnion CIBIL services not covered hereunder.

6. Force Majeure

TransUnion CIBIL shall not be liable for any failure to perform any of its obligations under these Terms or provide the Report/s and/or the Products and Services or any part thereof if the performance is prevented, hindered or delayed by a Force Majeure Event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure Event continues.

Force Majeure Event means any event due to any cause beyond the reasonable control of any Party, including, without limitation, unavailability of any communication system, breach or virus in the systems, fire, flood, explosion, acts of God, civil commotion, riots, insurrection, war, acts of government or acts of third party/ies.

7. Governing Law, Jurisdiction And Arbitration

These Terms are governed by and are subject to Indian laws.

In the event of any claim, dispute or difference arising out of or in relation to these Terms, the claim, dispute or difference shall be referred to arbitration to be conducted by a sole arbitrator to be appointed by TransUnion CIBIL who shall be the presiding arbitrator and the decisions and award of the arbitral tribunal shall be final and binding. The arbitration proceedings shall be held in Mumbai and shall be conducted in the English language and be governed by the provisions of Arbitration and Conciliation Act, 1996 and any modification or re-enactment thereof in force at the relevant time. All costs of such arbitration shall be borne by the Consumer.

Subject to what is stated above, any matters which may require the intervention or any determination by a Court, including any appointment of any arbitrators under Section 11 of the Arbitration and Conciliation Act, 1996, whether prior to, or during or after the aforesaid arbitration, shall be subject to the exclusive jurisdiction of the Courts in Mumbai.
